Terms And Conditions Of Service

1.   DEFINITIONS AND INTERPRETATION

  • In these Terms and Conditions, unless the context otherwise requires:
    • (a) Words in the singular shall include the plural and vice
    • (b) “Agreement” refers to the legally binding contract between The Moving Team and the Customer, which includes these Terms and Conditions and the accepted Service Proposal.
    • (c) “Customer” refers to the individual, company, or entity that has engaged The Moving Team for Services.
    • (d) “Goods” shall have the meaning ascribed under Section 246 of the Contract and Commercial Law Act 2017.
    • (e) “Proposal” refers to any formal communication from The Moving Team to the Customer outlining the terms, costs, and scope of the Services.
    • (f) “Service Proposal” means the written offer issued by The Moving Team to perform the Services specified therein.
    • (g) “Services” include, but are not limited to, the loading, transportation, packing, unpacking, and handling of Goods.
    • (h) “Terms and Conditions” refer to the legally enforceable provisions contained in this

2.   CONTRACTUAL AGREEMENT

  • These Terms and Conditions govern the legal relationship between The Moving Team and the Customer.
  • The Customer agrees that all services provided by The Moving Team are subject to these legally binding Terms and Conditions.

3.   SERVICE PROPOSALS

  • Binding Agreement: A Service Proposal shall only become legally binding upon acceptance by the Customer within 28 days of its date of Failure to accept within this timeframe will render the proposal null and void.
  • Service Charges:
  • Charges for Services shall be calculated based on the actual time spent (subject to a minimum charge of three hours) and all related costs incurred.
  • Time shall be measured in 30-minute increments, including travel time to and from the service location.

4.   CUSTOMER RESPONSIBILITIES AND WARRANTIES

  • Legal Authority Over Goods: The Customer warrants and represents that they have the legal right, title, and authority over all Goods entrusted to The Moving Team for removal or storage. The Customer shall indemnify The Moving Team against all liabilities arising from a breach of this warranty.
  • The Customer shall be responsible for ensuring that:
    • No Goods intended for removal are left
    • No Goods or fixtures are removed in
    • Any Goods left at unoccupied premises are adequately
    • No hazardous, prohibited, or illegal items are included in the

5.   LOSS, DAMAGE, AND LIABILITY

  • Services Provided on an Owner’s Risk Basis: All Services provided by The Moving Team are undertaken strictly at the owner’s risk, as defined in Section 250 of the Contract and Commercial Law Act 2017. The Moving Team shall not be liable for any loss or damage to the Goods except where such loss or damage is caused intentionally or due to negligence.
  • Limitation of Liability: The Moving Team shall not be liable for:
    • Loss, damage, or deterioration of
    • Delays in delivery due to unforeseen
    • Any damage to property, structures, or premises during the provision of
    • Indirect or consequential losses, including financial
  • Customer Responsibility for Valuables: The Customer must ensure that all expensive valuables, including but not limited to money, jewelry, important documents, and other high-value items, are either moved or securely stored before the arrival of The Moving Team’s crew at their The Moving Team shall not be held liable for any missing or misplaced valuable items.

6.   CANCELLATION POLICY

  • Customer Cancellations:
    • The Customer must provide a minimum of 48 hours’ notice for cancellations by calling The Moving Team’s office.
    • A 3-hour cancellation fee applies for cancellations made less than 48 hours before the scheduled move, plus any supplier charges.
    • A $100 + GST cancellation fee applies for cancellations made more than 48 hours before the scheduled move.
  • Cancellation by The Moving Team:
    • The Moving Team reserves the right to cancel the Contract due to unforeseen circumstances, including but not limited to extreme weather, accidents, government- imposed restrictions, or operational issues.
    • In such cases, The Moving Team will notify the Customer at the earliest opportunity and, where possible, reschedule the Services.

7.   INDEMNIFICATION

  • Customer Liability: The Customer agrees to indemnify and hold harmless The Moving Team, its employees, agents, and subcontractors against all claims, fines, penalties, or liabilities arising from:
    • The misrepresentation of
    • The presence of prohibited or hazardous
    • Breaches of laws relating to transportation or property
    • Third-party claims for injury or damage due to the Customer’s actions or

8.   GOVERNING LAW AND JURISDICTION

  • Legal Framework: These Terms and Conditions shall be governed by and interpreted in accordance with the laws of New Zealand.
  • Court Jurisdiction: Any disputes arising under these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of New Zealand.
